1. Scope and acceptance

本条款由你与 WeKare Partners LLC（“我们”）订立，适用于 PixaRivo 图漾 iOS 应用、官网及直接相关的模板、图片上传、云端合成、任务和作品管理服务。

These Terms are between you and WeKare Partners LLC (“we,” “us,” or “our”) and apply to the PixaRivo iOS app, website, and directly related template, image upload, cloud composition, job, and work-management services.

通过 Apple App Store 下载或使用 App 时，Apple 标准最终用户许可协议及适用的 App Store 规则也可能适用。本条款用于约定 PixaRivo 服务，不排除你依法享有的强制性消费者权利。

When you download or use the app through the Apple App Store, Apple’s Standard End User License Agreement and applicable App Store rules may also apply. These Terms govern PixaRivo services and do not exclude mandatory consumer rights.

PixaRivo provides curated visual templates, template details, image and text replacement, cloud visual composition, example browsing, job progress, and work management. Available features, regions, devices, languages, templates, formats, and allowances are determined by the current app and in-product descriptions.

PixaRivo 使用人工智能模型和第三方技术服务处理你提交的素材。受模型能力、输入质量、网络、队列和第三方服务影响，结果可能存在偏差、瑕疵、不完整、不可用或与预期不一致。我们不保证结果必然准确、唯一、无瑕疵或适合特定用途。

PixaRivo uses AI models and third-party technology services to process submitted materials. Results may be inaccurate, incomplete, defective, unavailable, or different from expectations due to model limitations, input quality, network conditions, queues, or third-party services. We do not guarantee that results are accurate, unique, error-free, or fit for a particular purpose.

3. 账户与安全

• 你应提供真实、合法、有效的账户信息，并妥善保管邮箱、密码和认证凭据；
• 通过你的账户发出的操作原则上视为你的操作；发现异常登录或凭据泄露时，应立即停止相关操作并联系我们；
• 不得出租、出借、出售或未经许可转让账户，不得自动化注册、批量养号或绕过验证；
• 你应对因主动泄露凭据、授权他人使用或未采取合理保护造成的后果依法承担责任。

• Provide lawful and valid account information and protect your email, password, and authentication credentials;
• Activity through your account is generally treated as your activity. If you detect unauthorized access or credential exposure, stop the relevant activity and contact us promptly;
• Do not rent, lend, sell, or transfer an account without permission, register accounts automatically or in bulk, or bypass verification;
• You are responsible to the extent required by law for consequences caused by voluntarily exposing credentials, authorizing others, or failing to use reasonable safeguards.

4. 上传素材与必要许可

4. Uploaded materials and permissions

你确认对上传或提交的图片、文字、商标、人物形象和其他素材拥有合法权利，或已经取得完成本次处理、合成和使用所需的充分授权。

You confirm that you own or have obtained all permissions needed to process, compose, and use every image, text, trademark, likeness, and other material you upload or submit.

• 不得上传违法内容、国家秘密、商业秘密、未授权资料或依法不得处理的信息；
• 非必要不得上传身份证件、财务、医疗、住址或其他敏感个人信息；处理他人信息时应取得合法授权；
• 你授权我们在提供服务所必要的范围内存储、复制、分析、转换和处理素材，并向受约束的技术服务商传输必要数据；该许可不转移素材所有权。

• Do not upload unlawful content, state secrets, trade secrets, unauthorized materials, or information that may not lawfully be processed;
• Do not upload identity documents, financial or medical information, addresses, or other sensitive personal information unless necessary. Obtain lawful authorization before processing another person’s information;
• You authorize us to store, copy, analyze, transform, process, and transmit materials to contracted technology providers only as necessary to provide the service. This license does not transfer ownership.

5. AI 合成结果与内容标识

5. AI-composed results and labeling

PixaRivo 合成或编辑的图片可能属于人工智能生成或合成内容。我们可能依据适用法律、平台政策和技术标准，在界面、文件、元数据或内部追溯记录中加入生成属性、内容编号、水印或其他标识。

Images composed or edited by PixaRivo may be AI-generated or synthetic content. As required by applicable law, platform policy, or technical standards, we may add generation attributes, content identifiers, watermarks, or other labels to the interface, files, metadata, or internal trace records.

• 公开发布或传播结果时，你应遵守当地规则并使用发布平台提供的 AI 内容标识能力；
• 不得恶意删除、伪造、遮挡或规避依法需要的生成合成内容标识；
• 发布、广告投放或商业使用前，你应自行检查事实、质量、人物、文字、品牌、权利和合规风险。

• When publishing or distributing a result, comply with local requirements and use the destination platform’s AI-content labeling tools;
• Do not maliciously remove, forge, cover, or bypass legally required AI-content labels;
• Before publication, advertising, or commercial use, independently review facts, quality, people, text, brands, rights, and compliance risks.

6. 用户行为规范

你不得使用 PixaRivo 制作、复制、展示或传播违法、有害、欺诈、侵权或滥用内容，也不得干扰服务正常运行，包括但不限于：

You must not use PixaRivo to create, copy, display, or distribute unlawful, harmful, deceptive, infringing, or abusive content, or interfere with normal service operation, including:

• 侵犯著作权、商标权、专利权、肖像权、名誉权、隐私权或个人信息权益；
• 冒充他人、伪造背书、诈骗、误导公众、操纵舆论或实施骚扰与仇恨行为；
• 制作违法色情、暴力、危险、歧视或剥削未成年人的内容；
• 攻击服务、绕过安全措施、批量抓取、逆向工程、滥用接口、异常消耗资源或转售服务能力；
• 将服务用于法律禁止或需要专业资质而你未取得资质的高风险用途。

• Infringing copyright, trademark, patent, likeness, reputation, privacy, or personal-information rights;
• Impersonating others, fabricating endorsements, committing fraud, misleading the public, manipulating opinion, harassing, or promoting hate;
• Creating unlawful sexual, violent, dangerous, discriminatory, or child-exploitative content;
• Attacking the service, bypassing safeguards, scraping at scale, reverse engineering, abusing interfaces, consuming abnormal resources, or reselling service capabilities;
• Using the service for prohibited high-risk purposes or regulated activity without required qualifications.

7. 积分、费用与任务处理

部分模板合成按积分或页面显示的其他额度计费。提交前显示的预计消耗和扣减规则构成具体任务规则。积分仅用于兑换 PixaRivo 服务，不是存款、证券或法定货币，除法律要求或明确规则允许外，不得提现、转让或兑换现金。

Some template compositions are charged through points or other allowances shown in the app. Estimated usage and deduction rules displayed before submission form part of the job terms. Points are used only to redeem PixaRivo services; they are not deposits, securities, or legal tender and cannot be withdrawn, transferred, or exchanged for cash unless required by law or expressly permitted.

任务实际调用模型或计算资源后可能产生不可逆成本。因平台故障导致任务明确失败时，我们会按照页面规则和核查结果处理相应积分；素材质量、输入问题、审美差异或结果未达到主观预期，不当然构成退还理由。任何在 iOS App 内提供的数字服务购买均应遵守 Apple App Store 规则。法定消费者权利不受不当限制。

A job may incur irreversible costs once model or compute resources are invoked. If a job clearly fails due to a platform fault, corresponding points will be handled under displayed rules and review results. Source quality, input issues, aesthetic differences, or failure to meet subjective expectations do not automatically qualify for a return. Any purchase of digital services offered in the iOS app must follow Apple App Store rules. Mandatory consumer rights remain unaffected.

你对自有上传素材享有的权利不因使用 PixaRivo 而转移。在遵守法律、本条款、第三方权利和相关模型限制的前提下，你可以使用交付给你的合成结果。结果能否取得著作权或其他专有权保护，应根据适用法律和具体创作事实判断。

Your rights in your uploaded materials do not transfer because you use PixaRivo. You may use delivered results subject to law, these Terms, third-party rights, and relevant model restrictions. Whether a result qualifies for copyright or other exclusive protection depends on applicable law and the facts of its creation.

AI 结果可能与第三方内容相似，或包含不准确的文字、人物、结构和品牌元素。我们不保证结果具有独创性、唯一性、不侵权或能够注册为商标、专利或著作权。

AI results may resemble third-party content or contain inaccurate text, people, structures, or brand elements. We do not guarantee originality, uniqueness, non-infringement, or eligibility for trademark, patent, or copyright registration.

如你主动把作品提交至公开案例库或明确授权展示，即授予我们为展示、推广、调整尺寸和技术分发所必要的非独占许可。你可以通过支持渠道申请停止后续公开展示，但依法需要保留的审计和安全记录不因此删除。

If you submit a work to the public Gallery or expressly authorize display, you grant us a non-exclusive license necessary to display, promote, resize, and technically distribute it. You may request that future public display stop, but legally retained audit and security records will not be deleted solely for that reason.

9. 隐私与第三方服务

我们会依据 PixaRivo 隐私政策处理个人信息。PixaRivo 可能使用云存储、内容分发、AI 模型和其他第三方技术服务，这些服务可能受其自身条款、隐私规则、可用性和地域限制约束。

We process personal information under the PixaRivo Privacy Policy. PixaRivo may use cloud storage, content delivery, AI models, and other third-party technology services, which may be subject to their own terms, privacy rules, availability, and regional restrictions.

对于第三方服务中断、政策调整、网络故障或不可抗力，我们会在合理范围内协助处理，但无法对超出合理控制范围的事项作绝对保证。

We will provide reasonable assistance for third-party interruptions, policy changes, network failures, or force-majeure events, but cannot make absolute guarantees about matters outside our reasonable control.

10. 服务变更、中止与终止

10. Changes, suspension, and termination

我们可能基于法律政策、模型能力、安全风险、运营安排或产品升级调整功能、模板、积分规则、额度和技术要求，并通过官网、App 或其他合理方式提示。重大不利变化会依法给予必要通知。

We may adjust features, templates, point rules, allowances, and technical requirements because of law, model capabilities, security risks, operations, or product upgrades. Notice will be provided through the website, app, or another reasonable method, with legally required notice for material adverse changes.

如你违反本条款、法律法规或危害用户和服务安全，我们可视情况警告、限制功能、下架内容、冻结账户、终止服务、保存证据或依法报告。你可以停止使用服务或按隐私政策申请删除账户。终止不影响终止前已经产生的付款、赔偿、知识产权和争议处理义务。

If you violate these Terms or law, or threaten users or service security, we may issue warnings, restrict features, remove content, freeze accounts, terminate service, preserve evidence, or report matters as legally appropriate. You may stop using the service or request account deletion under the Privacy Policy. Termination does not affect payment, compensation, intellectual-property, or dispute obligations arising beforehand.

11. 免责声明与责任限制

11. Disclaimers and limitation of liability

我们会依法提供服务并处理可归责于平台的问题。除法律明确规定外，对于模型固有不确定性、用户违法或未经审查的使用、第三方服务异常、网络故障或不可抗力造成的间接损失、预期收益损失或商誉损失，我们不承担超出法定范围的责任。

We provide the service lawfully and address matters attributable to us. Except where law requires otherwise, we are not responsible beyond the legally applicable scope for indirect losses, lost anticipated profits, or reputational harm caused by inherent model uncertainty, unlawful or unreviewed use, third-party failures, network failures, or force majeure.

任何免责或责任限制均不排除因我们故意或重大过失造成的责任，也不排除依法不得限制的消费者权益、人身损害或其他责任。

No disclaimer or limitation excludes liability for intentional misconduct or gross negligence, or any mandatory consumer, personal-injury, or other liability that cannot legally be limited.

12. 条款更新、适用法律与争议

12. Updates, governing law, and disputes

我们可能根据法律和服务变化更新本条款，并在本页标注新的生效日期。涉及重大权益的不利变化时，我们会依法进行显著提示。更新生效后继续使用服务，表示你接受更新后的条款。

We may update these Terms to reflect legal or service changes and will identify the new effective date on this page. Material adverse changes will be highlighted as required. Continued use after an update takes effect constitutes acceptance of the updated Terms.

除你所在地区的强制性法律另有规定外，本条款适用 WeKare Partners LLC 依法适用的法律，不适用法律冲突规则。发生争议时，双方应先通过 [email protected] 友好协商；协商不成的，可向依法具有管辖权的法院提起诉讼。消费者依法享有的强制性管辖和救济权利不受影响。

Unless mandatory law in your region provides otherwise, these Terms are governed by the laws applicable to WeKare Partners LLC, without regard to conflict-of-law rules. The parties should first attempt good-faith resolution through [email protected]. If unresolved, either party may bring a claim before a court with lawful jurisdiction. Mandatory consumer jurisdiction and remedies remain unaffected.
